1. About these terms
These terms govern your use of the Parikshak website, desktop software, AI gateway and related services (together, the Service), provided by Parikshak (the Company). By creating an account or using the Service you agree to them. If you use the Service for an organisation, you confirm you can bind that organisation.
2. Accounts and seats
Each paid plan includes up to five named logins for one organisation. Logins are personal and may not be shared outside those five users. You are responsible for activity under your accounts and for keeping credentials safe.
3. Plans, test runs and credits
Plans are billed monthly in Indian rupees and exclude GST. The ₹9,999/month plan includes 5 logins and 10 test runs per month, and the ₹21,499/month plan includes 5 logins and 30 test runs per month, along with each plan's monthly AI credit allowance. Unused monthly test runs and AI credits do not roll over unless stated otherwise. We may change prices or plan features with at least 30 days' notice before your next billing cycle.
4. Authorised testing only
You may use the Service only to test applications, websites and devices that you own or have written permission to test. You must not use it to attack, scrape, overload or gain unauthorised access to any system, to bypass security controls, or to process data you have no right to use. You are responsible for any real transactions or changes your tests perform, so use test or demo environments where possible.
5. Your content and data
You keep ownership of your test cases, recordings, screenshots, reports and any app data you test. You give us a limited licence to process that content only to provide the Service. Test data and credentials are stored in encrypted form on your own machine unless a feature states otherwise.
6. AI features
Some features send limited content, such as screen text or screenshots, to AI providers through our gateway so they can suggest tests or diagnoses. AI output can be wrong. Tests run only after you approve them, and you are responsible for reviewing them before relying on results.
7. Intellectual property
The Service, its software, branding and documentation belong to the Company and its licensors. We grant you a non-exclusive, non-transferable right to use the Service during your subscription. You may not copy, reverse engineer or resell the Service except as the law allows.
8. Availability and support
We aim to keep the Service available but do not promise uninterrupted operation. Planned maintenance and third-party outages may occur.
9. Warranty disclaimer and liability
The Service is provided as is. To the extent allowed by law, we exclude implied warranties and are not liable for indirect or consequential loss, lost profits, or data loss. Our total liability for any claim is limited to the fees you paid in the three months before the claim arose.
10. Suspension and termination
You may cancel at any time as described in the Refund and Cancellation policy. We may suspend or end access if you breach these terms or misuse the Service, and will give notice where reasonably possible.
11. Governing law
These terms are governed by the laws of India. Courts at [CITY], India have exclusive jurisdiction, subject to any mandatory consumer rights.
